During the FMLA leave, the foster parent is entitled to maintain their health benefits under the same terms and conditions as if they were working. However, it is important to note that the foster parent will not receive their regular pay during this time. Some foster parents may be eligible for other forms of financial assistance, such as state or local foster care subsidies, to help cover their expenses while on leave.

Upon returning from FMLA leave, the foster parent is entitled to be restored to their original position or to an equivalent position with equivalent pay, benefits, and other terms and conditions of employment.
